Have you suffered an injury due to a slip, a trip or a fall?

If you have had a fall in a public place such as a supermarket or in the street and this is caused for example by a defect or hole in the floor or ground, a wet floor or protruding object you may have a claim against the person or group responsible for the upkeep and maintenance of the area where it happened.

To make a claim you must have been injured in the last three years and the accident must have been someone else's fault. Generally we can only help you if your injury required medical attention

Accidents can happen in the following:

  • Accidents on the roads or pavements. Your local council has a legal duty to maintain the roads and pavements to a reasonable standard.
  • Accidents in Shops. Shopkeepers have a legal duty to ensure the safety of their customers whilst on their premises, including the car park.
  • Accidents in other places. Places that are accessible to the public are also covered by laws to protect people from injury.

Things you should do:

  1. Make note of the road name where the incident occurred.
  2. Take details of any witness to the incident.
  3. If possible take a photograph of the defect that caused the incident, with something to show a scale – such as a ruler, a coin or an object of a fixed size, or a make a plan of the accident site.
